DECISION
Defining functions, tasks, rights and organizational structure
of the Government Portal
____________
Pursuant to the Law on the Organization of the Government dated December 25, 2001;
Pursuant to Decree 08/2012/ND-CP dated December 16, 2012, promulgating the working regulations of the Government;
Pursuant to Decree 74/2012/ND-CP dated December 29, 2012 of the Government stipulating functions, tasks, rights and organizational structure of the Office of Government;
Upon the proposal of the Minister-Chairman of the Office of Government,
The Prime Minister issues this Decision to define functions, tasks, rights and organizational structure of the Government Portal.
Article 1. Position and functions
1. The Government Portal is an electronic administrative information integrating agency and a multi-media communication agency of the Government under the Office of Government. It is directly managed by the Minister-Chairman of the Office of Government (hereafter called the Minister-Chairman).
2. The Government Portal is functioned to organize, manage and publicize official information issued by the Government and the Prime Minister; act as the point of entry to connect the e-administrative networks of the Government, Ministries, Ministerial-level agencies, Governmental bodies, People’s Councils and People’s Committees of provinces and centrally-governed cities (hereafter called the Ministries, agencies and localities), and relevant agencies and organizations; and integrate information on online public services of the Government.
The Government Portal has an international transaction name in English -- Viet Nam Government Portal (VGP in short).
3. The Government Portal is an administrative organization having a legal entity status, an Emblem-shaped stamp, and a State Treasure account; its operation is covered by the State budget.
Article 2. Tasks and rights
The Government Portal assists the Minister-Chairman in implementing the following specific tasks and rights:
1. Taking the prime responsibility for coordinating with relevant units, agencies, and organizations to submit key strategies, plans and projects of the Government Portal to the Minister-Chairman for approval under his authorization or to the Prime Minister for approval; collaborating with relevant agencies and units to organize the implementation of the aforesaid documents once they are approved.
2. Coordinating with relevant agencies and units to ensure information supply to serve the Government, the Prime Minister, and the Office of Government; playing as a nerve center from which official information of the Government, the Prime Minister, and the Office of Government are organized, managed, and publicized on the Government Online Newspaper and the website of the Office of Government.
3. Coordinating professionally with Ministries, agencies, localities, and relevant agencies and organizations to connect and synchronize data (uncategorized as State confidential information) integrated at the Government Electronic Database Center; standardize application software, exploit national information resources; exploit, receive, integrate, and update fully and timely all categories of information (uncategorized as State confidential information); ensure the process of sharing and exchanging information is adaptive and smooth to suit the administrative reform program and meet requirements of instructive and executive affairs of the Government and the Prime Minister and the roadmap to build an e-Government.
4. Taking the prime responsibility for coordinating with Ministries, sectors, localities, and relevant agencies and organizations to integrate the Government’s online public services.
5. Coordinating with units of the Office of Government to exploit, receive, handle, and update fully and timely various categories of information (which are uncategorized as State confidential information) to perform the assigned functions, tasks and rights in accordance with legal regulations.
6. Taking the prime responsibility for coordinating with relevant units to organize press briefings, communicate with the media, and prepare for press interviews granted by the Prime Minister, the Deputy Prime Ministers, and the leaders of the Office of Government; prepare press round-ups and summaries; propose the Prime Minister or the Deputy Prime Ministers to ask the Ministries, agencies and localities to check and report back the issues raised by the press; coordinate with relevant units to handle the issues raised by the press in accordance with instructions given by the Prime Minister or the Deputy Prime Ministers.
7. Organizing the management and operation of the Government Online Newspaper, the website of the Office of Government and other websites in accordance with legal regulations.
8. Organizing exchanges, periodical meetings, online dialogues, and other forms of information technology-based communications between the Government, the Prime Minister, Ministries, sectors, localities, and organizations involved the public.
9. Receiving online complaints and petitions lodged by organizations and individuals to the Government, the Prime Minister, and State administrative agencies, to forward to competent agencies and organizations to address or reply in accordance with legal regulations.
10. Designing technological, technical, and artistic structure of the Government Portal as well as storage capacity of information and data resources possessed by the Government Portal; developing and diversifying the contents, forms of operations and applications, and media products in order to raise the capacity of communication and popularization of guidelines and policies of the Party, laws of the State, domestic and global socio-economic situation and news; and effectively serving instructive and executive affairs of the Government and the Prime Minister.
11. Taking the prime responsibility for collaborating with relevant agencies and organizations to manage, publish and distribute printed and electronic Official Gazette of the Socialist Republic of Viet Nam.
12. Managing and operating the public e-mail system of the Government on the Internet, the Government Electronic Data Center, and technological infrastructure and specialized technical equipment.
13. Managing and implementing the assigned investment projects in accordance with legal regulations; participating in consulting, designing, and appraising plans and projects relating to professional areas of websites/portals of Ministries, sectors, localities and organizations once requested; participating in appraising professionally other important projects under the assignment of the Minister-Chairman.
14. Providing re-training and instructions regarding professional and electronic administration knowledge and expertise that relate to the operation of the Government Portal as stipulated by law.
15. Studying and applying scientific and technological advances to raise the operation efficiency of the Government Portal.
16. Establishing international cooperation within the operation scope of the Government Portal as stipulated by law.
17. Taking the prime responsibility for coordinating with other units of the Office of Government and relevant agencies to ensure information carried by the Government Portal is kept secret, safe and secure.
18. Providing services and value-added activities in accordance with legal regulations and instructions provided by the Ministry of Finance without affecting its assigned political tasks.
19. Managing and organizing its apparatus and staff; implementing salary regimes, preferential treatments and bonus and disciplinary policies on its staff and collaborators in accordance with legal regulations.
20. Managing and using the assigned properties, allocated fund and other financial sources in accordance with legal regulations.
21. Implementing other tasks and rights assigned by the Prime Minister and the Minister-Chairman.
Article 3. Organizational structure and staff
1. The Government Portal is headed by a Director-General and Deputy Director-Generals.
The Director-General of the Government Portal (hereafter called the Director-General) is appointed, removed, or fired by the Minister-Chairman; responsible before the Minister-Chairman, the Prime Minister, and law for the entire operation of the Government Portal.
The Deputy Director-Generals are appointed, removed, or fired by the Minster-Chairman; responsible before the Director-General and the Minister-Chairman for the performance of their assigned areas.
The Director-General or a Deputy Director-General is assigned to concurrently work as the Editor-in-chief of the Government Online Newspaper.

c) Office
d) Government Online Newspaper (with representative offices posted in Ho Chi Minh City, central Da Nang city, and Mekong delta Can Tho city)
dd) Center for Technology and Multi-media
e) Government Integrated Data Center
At this clause, the units mentioned in point a, b, and c are administrative units; the units mentioned in point d, dd, and e are non-profit units.
The Government Online Newspaper is organized and operates to the model of a press, information and communication agency; and is subject to State management in terms of information and communications of the Ministry of Information and Communications as stipulated by law.
3. When there are requirements for development of the Government Portal, the Director-General proposes the Minister-Chairman to submit to the Prime Minister decisions to establish new units, merger, dissolve, or rename the names of units stipulated in Clause 2 of this Article.
4. The Minister-Chairman stipulates functions, tasks, rights and organizational structure of the Government Online Newspaper. The Director-General stipulates functions, tasks, and rights of the other units of the Government Portal; appoint, remove, or fire heads of the Government Portal’s units in accordance with legal regulations. If necessary, the Director-General submits to the Minister-Chairman decisions to establish some sub-units of the units stipulated in Clause 2 of this Article.
5. The staff of the Government Portal is decided by the Minister-Chairman in accordance with legal regulations.
Article 4. Effective date
This Decision takes effect on March 15, 2013; and replaces Decision 83/2008/QD-TTg dated June 25, 2008 of the Prime Minister stipulating the functions, tasks, rights and organizational structure of the Viet Nam Government Web Portal.
Article 5. Responsibility of implementation
The Ministers, the Heads of the Ministerial-level agencies, the Heads of Governmental bodies, the Chairmen of the People’s Committees of provinces and centrally-governed cities, the Director-General of the Government Portal, and relevant agencies and organizations are responsible for implementing this Decision./.
