DECISION
Defining functions, tasks,
rights and organizational structure
of the Government Web Portal

PRIME MINISTER
Pursuant to the Law on the Organization of the Government
dated on December 25, 2001;
Pursuant to Decree 33/2008/NĐ-CP dated on March 19, 2008 by
the Government stipulating functions, tasks, rights and organizational structure
of the Office of Government;
Upon the proposal of the Minister-Chairman of the Office of
Government,
DECIDES
Article 1. Position and functions
1. The Việt Nam Government Web Portal (VGP) is an integrated
information portal and also a multimedia e-newspaper of the Government on the
Internet, directly managed by the Minister-Chairman of the Office of Government
(hereinafter called the Minister-Chairman).
2. The Government Web Portal has the functions of (i)
organizing, managing, and disseminating the Government’s formal information on
the Internet; (ii) being the hub of e-administrative information networks of the
Government, ministries, ministerial agencies, governmental bodies, People’s
Councils and People’s Committees of provinces and centrally-administered cities
(hereinafter called Ministries, sectors, and localities), and other related
organizations; and (iii) integrating information about public services of the
Government on the Internet.
Its official English name is the Việt Nam Government Web
Portal (abbreviated as VGP).
3. The Government Web Portal is a non-productive unit with
its own legal status, stamp, and account. Its operations are funded by the State
budget. It is organized as a newspaper and information agency which operates
under the State information and communication management of the Ministry of
Information and Communications in line with laws.
Article 2. Tasks and rights
The Việt Nam Government Web Portal shall assist the
Minister-Chairman to undertake the following tasks:
1. To function as the main player, in coordination with
relevant units, Ministries and sectors, in submitting its own strategies, plans,
and important projects to the Minister-Chairman or the Prime Minister for
approval; coordinate with other relevant bodies to realize those approved
strategies, plans and projects;
2. To professionally coordinate with other relevant
Ministries, sectors, localities, bodies, and organizations to link and
synchronize database (not categorized as State secrets) which is updated on the
Government Web Portal; standardize software to use and exploit national
information resources when integrating websites or portals into an electronic
information web-system; exploit, receive, integrate and fully update on time all
kinds of information (not categorized as State secrets); ensure the
compatibility and harmony during the process of information sharing and
exchanging, in line with the Government and the Prime Minister’s administrative
reform program as well as with the roadmap of e-government construction;
3. To function as the main player, in coordination with
relevant Ministries, sectors, localities, bodies, and organizations, in
integrating information of public services of the Government on the Internet;
4. To coordinate with the Office of Government’s units to
fully exploit, receive, and timely update all kinds of information (not
categorized as State secrets) in order to fulfill its assignments and
obligations as stipulated by laws;
5. To organize and conduct online dialogues, videoconferences
and other IT-based forms of contact between the Prime Minister and leaders of
the Government, Ministries, sectors and localities, and people;
6. To receive denouncements, complaints, petitions and
queries from organizations or individuals sent to the Government, Prime
Minister, and the Office of Government through the Internet; then forward them
to the competent bodies for solutions or answers in accordance with legal
regulations;
7. To design the technological and artistic structure for the
Government Web Portal and the database capacity of the Portal; diversify
contents, activities and multimedia products to raise the ability of
disseminating the Party’s guidelines and policies, State’s laws, socio-economic
situations and news on Việt Nam and the world; effectively serve the performance
of the Government and the Prime Minister;
8. To
coordinate with other websites or portals of Ministries, sectors and localities
in professional activities;
9. To work with relevant units to publish electronic official
gazette of the Socialist Republic of Việt Nam on the Government Web Portal;
10. To manage the Government’s online database center and
technological infrastructure;
11. To manage and realize investment projects assigned in
line with laws; take part in consulting about, designing and assessing projects
relating to professional fields in the system of websites and web portals of
ministries, sectors, localities and relevant organizations and agencies as
required; give professional assessments of other important projects assigned by
the Minister-Chairman;
12. To organize professional training courses necessary for
the performance of the Government Web Portal in conformity with legal
regulations;
13. To research and apply scientific and technological
advances in order to improve the performance of the Government Web Portal;
14. To undertake international cooperation in the fields
stipulated by laws;
15. To function as the main player, in coordination with the
Office of Government’s units and other relevant bodies, in ensuring the secrecy,
network safety, system security, and internal security;
16. To conduct added value services as stipulated by laws and
in line with instructions of the Ministry of Finance in order to fruitfully use
and re-invest in the available facilities;
17. To manage its organizational apparatus and personnel;
apply polices on salary, commendation and punishment to its employees and
coordinators in line with legal regulations;
18. To manage and use properties, funds and other financial
resources allocated to the Government Web Portal under legal regulations;
19. To fulfill other tasks and
missions assigned by the Prime Minister and the Minister-Chairman.
Article 3. Organizational structure and staff
1. The Government Web Portal shall have an editorial of one
(01) Director-General and not more than three (03) Deputy Director-Generals.
The Director-General of the Government Web Portal
(hereinafter called the Director-General) shall be appointed or dismissed by the
Minister, Chairman of the Office of Government. The Director-General shall be
responsible to the Minister, Chairman of the Office of Government and laws for
the performance of the Government Web Portal.
The Deputy Director-Generals shall be appointed or dismissed
by the Minister, Chairman of the Office of Government in line with legal
regulations. They shall be responsible to the Minister, Chairman of the Office
of Government and the Director-General for activities within their competence.
2. Organizational structure
a) Department of Secretarial and General Affairs;
b) Department of Professional Affairs;
c) Department of Technologies;
d) Department of Planning and Finance;
đ) Department of International Cooperation;
e) Office;
g) Center for Research and Development.
3. Resident representative offices in Hồ Chí Minh City, Đà
Nẵng City and Cần Thơ City.
4. The establishment of overseas representative offices shall
be decided by the Minister-Chairman in conformity with the Prime Minister’s
permission.
5. Upon the development of the Government Web Portal, the
Minister-Chairman shall propose the Prime Minister to establish, merge, dissolve
or rename the units stipulated in Items 2, 3, and 4 of this Article.
6. The Minister-Chairman shall appoint and dismiss managers
of the units stipulated in Items 2, 3, and 4 of this Article.
7. The Director-General shall define in details functions,
tasks and rights of all units of the Government Web Portal. If necessary, the
Director-General shall submit for the Minister-Chairman’s decision the
establishment of some divisions in the units stipulated in Items 2, 3, and 4 of
this Article.
8. The personnel of the Government Web Portal shall be fixed
by the Minister-Chairman in conformity with legal regulations.
Article 4. Validity
1. This Decision shall come into force within 15 days since
it is publicized on the Public Gazette; It replaces the Prime Minister’s
Decision 229/2003/QĐ-TTg dated on November 07, 2003 on the establishment of the
website of the Government of the Socialist Republic of Việt Nam. It also
replaces the Prime Minister’s Decision 250/2005/QĐ-TTg dated on October 10, 2005
on the organization and operation of the Government website.
2. All previously-issued regulations which are contrary to
this Decision shall be abrogated.
Article 5. Responsibility
Minister, heads of ministerial-level agencies, heads of the
Government-administered agencies, Chairpersons of the People’s Councils and
People’s Committees of provinces and centrally-administered cities,
Director-General of the Government Web Portal and relevant organizations shall
be responsible for enforcing this Decision./.
